Protecting your private information is our priority. This Statement of Privacy applies to Flave, and Flave App, Inc. and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Flave App, Inc. include https://flave.app/ and Flave. The Flave application is a restaurant application. By using the Flave application, you consent to the data practices described in this statement.

Collection of your Personal Information

Flave may collect anonymous demographic information, which is not unique to you, such as your age, gender, race, religion, political affiliation, household income, and anonymized food pictures uploaded by users to be used on Flave’s social media and to provide to restaurants.

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services. These may include: (a) registering for an account; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services. To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

Flave relies on third parties to provide information to us so that Flave can make it available to the user. Flave accepts no liability for any loss, direct or indirect, that the user may experience as a result of relying wholly on the functionality of the app.

Sharing Information with Third Parties

Flave does not sell, rent or lease its customer lists to third parties.

Flave may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is transferred to the third party. Flave may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to Flave, and they are required to maintain the confidentiality of your information.

Flave may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Flave or the site; (b) protect and defend the rights or property of Flave; and/or (c) act under exigent circumstances to protect the personal safety of users of Flave, or the public.

It is the users responsibility to keep their phone and access to the app secure. Flave shall not be responsible for the app not working at full functionality if you do not have access to Wi-Fi and/or if you do not have any of your data allowance left. If you are using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. In using the app, the user accepts responsibility for charges issued by your mobile provider including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. Flave shall not take responsibility for the manner in which the user uses the app.

Children Under Thirteen

Flave does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this application.

Opt-Out & Unsubscribe from Third Party Communications

Changes to this Statement

Flave reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our application, and/or by updating any privacy information. Your continued use of the application and/or Services available after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.

You are not allowed to copy or modify the app, any part of the app, or our trademark in any way. You are not allowed to attempt to extract the source code or the app. You should not try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it shall still belong to Flave App, Inc.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Flave App, Inc. does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the app and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
